Section 01 Nature of the Project & Youth-Led Disclaimer Next Gen Studios, Next Gen Academy, The War Room, and all associated programs, shows, platforms, courses, events, and creative initiatives (collectively referred to herein as "Next Gen" or "the Project") are not a corporation, registered business entity, limited liability company, nonprofit, or any other formally incorporated commercial organization. Next Gen Studios is an independent, youth-led creative and developmental project conceived, directed, and operated by Jaaziel Bournes, a minor currently residing in the United States. Because Next Gen Studios is operated by a minor, it does not and legally cannot enter into binding commercial contracts, employ individuals in the traditional legal sense, or operate as a registered business under any state or federal law. All activities undertaken under the Next Gen umbrella are voluntary collaborative contributions to a youth-driven creative project, not employment arrangements, business transactions, or commercial partnerships of any legally enforceable nature beyond what is expressly outlined in these Terms. By accessing, using, participating in, or contributing to any Next Gen service, platform, program, event, or initiative, you expressly acknowledge and accept all of the following:

You understand that Next Gen Studios is operated entirely by youth and that all creative, operational, logistical, and administrative decisions are made by young people, including those who are minors.
You understand that processes, timelines, deliverables, communications, and service offerings may evolve, be delayed, be modified, or be discontinued at any time without prior notice.
You agree that no participant, contributor, collaborator, or end user may bring a claim for damages, unpaid compensation beyond what was explicitly agreed, or any other legal or equitable remedy solely on the basis that the project is youth-led or operated by a minor.
You agree that all services, platforms, programs, and content are provided on a strictly "as-is" basis, without warranties, guarantees, professional assurances, or representations of any kind, whether express or implied.
You acknowledge that the informal and evolving nature of this project is inherent and known to you at the time of your participation.

Nothing in these Terms shall be construed as creating an employment relationship, a business partnership, a joint venture, an agency arrangement, or any other legally recognized commercial relationship between Next Gen Studios and any participant, contributor, or user.

Section 02 Acceptance of Terms These Terms of Service ("Terms") constitute the complete and entire agreement between you and Next Gen Studios with respect to your access to and use of any Next Gen platform, service, program, event, course, or digital content. By accessing, viewing, interacting with, submitting content to, or participating in any capacity within any Next Gen service or platform, you agree to be fully and unconditionally bound by these Terms, as well as any additional policies, guidelines, or supplemental agreements that may be posted, communicated, or referenced herein. Your continued access to or use of any Next Gen service, on any device, through any interface, or via any third-party platform that hosts or distributes Next Gen content, constitutes your ongoing and affirmative acceptance of all terms contained herein, including any modifications made subsequent to your initial access. You are responsible for reviewing these Terms periodically to remain informed of any updates. If you do not agree to any portion of these Terms, you must immediately discontinue all use of and access to Next Gen services, platforms, and programs. Continued use following any update constitutes irrevocable acceptance of the revised Terms. If you are a minor and are accessing or using any Next Gen service, you represent that you have obtained appropriate parental or guardian consent where required by applicable law. Next Gen Studios assumes no responsibility for unauthorized use by minors who have not obtained such consent.

Section 03 Project Contributor Agreements From time to time, Next Gen Studios may invite, recruit, or accept individuals to contribute to the Project in a creative, technical, or operational capacity. This includes but is not limited to game developers, programmers, 3D modelers, graphic designers, UI/UX designers, VFX artists, environment builders, voice actors, writers, editors, social media contributors, and any other role that produces work product intended for use within or in connection with any Next Gen initiative. Any individual who accepts an invitation or otherwise agrees — whether verbally, in writing, through a platform message, or by beginning work — to contribute to any Next Gen project thereby enters into a contributor agreement governed by these Terms. By beginning, continuing, or delivering any work for Next Gen Studios, you agree to all of the following:

3.1 — Project Completion Obligation Upon accepting a project assignment, role, or task from Next Gen Studios, you agree to complete that assignment to a reasonable standard of quality and within any communicated timeframe. Abandoning an accepted project without reasonable notice, communication, or an agreed-upon handoff may result in forfeiture of any agreed compensation and removal from future contributor opportunities.

3.2 — Ownership of Work Product All work product, deliverables, assets, code, designs, artwork, audio, animations, scripts, written content, and any other creative or technical output produced in whole or in part for or within the scope of a Next Gen project immediately and irrevocably becomes the sole intellectual property of Next Gen Studios upon delivery, submission, or first use — whichever occurs first. You hereby assign, transfer, and convey all rights, title, and interest in and to such work product to Next Gen Studios in perpetuity, worldwide, without further compensation beyond what was explicitly agreed prior to the commencement of work.

3.3 — No Retained Rights Once work product has been delivered to or used by Next Gen Studios, the contributor retains no right to withdraw, revoke, reclaim, relicense, or otherwise restrict Next Gen Studios' use of that work. Contributors may not remove their contributions from Next Gen projects after the fact, regardless of changes to their relationship with the Project.

3.4 — Portfolio Usage Contributors may reference their participation in Next Gen projects for personal portfolio or resume purposes, provided that such references do not disclose confidential information, misrepresent their role, or imply an employment relationship. Contributors may not publicly distribute, sell, or commercially exploit any work product created for Next Gen Studios without prior written consent from project leadership.

Section 04 Compensation & Payment Terms Next Gen Studios may, at its sole discretion, offer compensation to contributors in recognition of their work on Project initiatives. Any offer of compensation is entirely voluntary and discretionary on the part of Next Gen Studios, and no contributor is entitled to compensation unless an explicit written or documented agreement has been made prior to the commencement of the relevant work. Compensation, where offered and agreed upon, may take the form of one or more of the following:

Robux — the in-platform virtual currency of the Roblox platform, which may be transferred via group payouts, game passes, or other Roblox-supported mechanisms. Robux compensation is subject to Roblox's own platform terms and policies, and Next Gen Studios is not responsible for any issues arising from Roblox's processing, holding, or distribution of Robux.
Cash (USD) — monetary compensation transferred via agreed-upon payment platforms such as PayPal, Cash App, Venmo, Zelle, or any other mutually agreed digital payment service. Cash compensation is subject to the terms of the respective payment platform used.
Other non-monetary forms — including but not limited to credit, recognition, promotional opportunities, or other agreed-upon arrangements explicitly documented before work begins.

All compensation arrangements must be agreed upon, documented, and confirmed by Next Gen Studios leadership before work begins. No verbal promises, informal understandings, or implied expectations of compensation shall be enforceable unless they are confirmed in writing by a representative of Next Gen Studios leadership. Next Gen Studios reserves the right to withhold, reduce, or forfeit any agreed compensation in the event that: (a) the contributor fails to complete the agreed project or deliverable; (b) the contributor violates any provision of these Terms; (c) the contributor engages in misconduct, leaks confidential information, or acts in a manner detrimental to the Project; or (d) the quality of the delivered work is materially below the agreed standard and the contributor refuses to make reasonable revisions. By accepting any compensation from Next Gen Studios, contributors acknowledge that they are not employees, contractors for tax purposes, or agents of Next Gen Studios in any legally recognized capacity, and that no employment, payroll, or tax withholding obligations arise from such compensation. Contributors are solely responsible for any tax obligations arising from compensation received.

Section 05 Allowed Clips & Content Sharing Next Gen Studios grants users and community members a limited, non-exclusive, non-transferable, revocable license to share publicly released clips, approved highlights, and officially published segments of Next Gen content for non-commercial purposes, provided that such sharing complies fully with these Terms and any additional platform-specific guidelines communicated by Next Gen leadership. This limited sharing license expressly does not extend to any of the following categories of content:

Unreleased footage, recordings, or content that has not been officially published or approved for distribution by Next Gen Studios leadership.
Behind-the-scenes material, internal discussions, planning sessions, production meetings, or draft content of any kind.
Private recordings, personal communications, or any media captured in contexts not intended for public distribution.
Internal documents, scripts, storyboards, planning materials, unreleased game assets, or course materials not publicly available.
Any content involving identifiable individuals who have not consented to its distribution.

Permitted sharing must not misrepresent, distort, satirize in a harmful manner, or otherwise damage the reputation of Next Gen Studios, its youth leadership, contributors, or associated programs. Any attempt to use shared clips in a manner designed to mock, undermine, or harm the Project will result in immediate revocation of sharing privileges and may result in further action as outlined in Section 10.

Section 06 Confidentiality & Prohibited Leaks All participants, contributors, community members, and any other individuals with access to Next Gen Studios' internal platforms, communications, materials, or operations are subject to a strict and binding confidentiality obligation. This obligation arises automatically upon access to any non-public Next Gen material, regardless of whether a separate written confidentiality agreement has been signed. You are strictly prohibited from leaking, publishing, distributing, transmitting, selling, or otherwise sharing any of the following without explicit prior written authorization from Next Gen Studios leadership:

Raw or unedited recordings of any kind, including audio, video, or screen captures.
Internal planning documents, scripts, timelines, roadmaps, or strategic materials.
Private communications between team members, leadership, or contributors, including Discord messages, emails, or any other messaging medium.
Unreleased game assets, code, models, textures, or builds in any state of development.
Enrollment data, course materials, or private program content not available to the general public.
Financial information, compensation arrangements, or payment discussions related to the Project.
Any media, information, or material created during the production process that has not been officially cleared for public distribution.

Violations of this confidentiality obligation will result in immediate and permanent termination of all access to Next Gen services and programs, forfeiture of any and all payments made or owed, and potential pursuit of any available legal remedies to the fullest extent permitted by applicable law.

Section 07 Educational Courses & Sensitive Topics Disclaimer Next Gen Studios offers a range of educational and developmental programs designed to promote personal growth, discipline, creative skill-building, leadership, and confidence among young people. Some of these programs, including but not limited to masculinity-focused development courses offered under The War Room or similar initiatives, may include themes, discussions, viewpoints, instructional methodologies, or perspectives that certain individuals may find controversial, uncomfortable, politically charged, or ideologically at variance with their own beliefs. By enrolling in or accessing any Next Gen educational program, course, or developmental initiative, you expressly acknowledge and agree to all of the following:

Participation in all Next Gen educational programs is entirely voluntary. You have the right to discontinue participation at any time, though no refund will be issued in accordance with Section 09 of these Terms.
Next Gen Studios does not intend to harm, target, discriminate against, or demean any individual, group, gender, identity, or belief system through its educational content.
You assume full and complete responsibility for your own interpretation of, emotional response to, and engagement with all course content.
You agree that Next Gen Studios, its youth leadership, instructors, contributors, and affiliated programs shall bear no liability for any adverse psychological, emotional, or interpersonal outcomes you attribute to participation in any Next Gen educational offering.

Section 08 Personal Property Disclaimer Next Gen Studios, Next Gen Academy, The War Room, and all related programs, events, and initiatives expressly disclaim all responsibility for the loss, theft, damage, destruction, misplacement, or unauthorized use of any personal property belonging to any participant, contributor, attendee, or community member. This disclaimer applies regardless of the circumstances under which the loss or damage occurred. Participants are solely and exclusively responsible for the safeguarding of their personal belongings at all times. No claims, demands, reimbursements, or compensation of any kind will be considered or provided under any circumstances.

Section 09 Payments, Billing & Refund Policy All payments made to Next Gen Studios in connection with any service, program, course, event, membership, or any other offering are final, non-refundable, and non-transferable under all circumstances. This policy applies without exception, including but not limited to the following situations:

Cancellation of enrollment or participation after payment has been received, regardless of whether the cancellation occurs before or after the service has been accessed or provided.
Removal, suspension, or termination of access due to a violation of these Terms or any other policy.
Dissatisfaction with content, outcomes, scheduling, or any other aspect of the service.
Changes to program structure, curriculum, or availability that occur after payment.
Technical issues, platform outages, or interruptions to service delivery beyond the control of Next Gen Studios.

By submitting a payment to Next Gen Studios through any payment method or platform, you authorize the applicable transaction and acknowledge that the funds are non-recoverable. Any attempt to initiate a chargeback, payment reversal, or dispute through a payment platform or financial institution — without first contacting Next Gen Studios through official channels and allowing a reasonable resolution period — shall be considered a violation of these Terms and may result in permanent termination of access to all Next Gen services.

Section 10 Access Revocation & Service Termination Next Gen Studios reserves the unconditional, unrestricted, and sole right to suspend, restrict, revoke, or permanently terminate any individual's access to any or all Next Gen services, platforms, programs, and communities at any time, for any reason or no stated reason, without prior notice, refund, or compensation of any kind. Grounds for immediate access revocation include, but are not limited to:

Leaking or distributing confidential or unreleased content in violation of Section 06.
Submitting a false, misleading, or bad-faith DMCA or intellectual property claim against Next Gen Studios.
Engaging in harassment, disrespect, threats, or abusive behavior directed toward any member of Next Gen youth leadership, staff, contributors, or community members.
Misuse, unauthorized distribution, or commercial exploitation of any Next Gen materials, assets, or content.
Fraudulent, deceptive, or dishonest conduct in connection with any Next Gen service or program.
Any action, statement, or conduct deemed by Next Gen Studios leadership to be materially harmful to the Project, its reputation, or its community.

Decisions made by Next Gen Studios youth leadership regarding access revocation are final and are not subject to appeal, review, or reversal except at the sole discretion of Next Gen Studios.

Section 11 Content Ownership & Media Release All content produced, recorded, submitted, or created within or for the purposes of any Next Gen Studios initiative — including without limitation gameplay recordings, voice performances, interviews, written contributions, coursework submissions, photography, graphic designs, digital artwork, and video productions — is and shall remain the exclusive intellectual property of Next Gen Studios and the Project. By participating in any Next Gen activity in which content is created or recorded, you hereby grant Next Gen Studios a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable license to record, reproduce, modify, adapt, publish, distribute, publicly display, publicly perform, create derivative works from, and otherwise use your voice, likeness, name, image, and any content you contribute, for any creative, promotional, educational, developmental, or commercial purpose related to the Project, without further notice, consent, or compensation beyond what was explicitly agreed prior to the contribution. You irrevocably waive any rights of approval, attribution, or compensation — including any moral rights, rights of publicity, and rights under applicable copyright law — to the extent that such rights may be waived under applicable law.

Section 12 DMCA & Intellectual Property Claims Next Gen Studios respects intellectual property rights and takes all legitimate claims seriously. Any individual or entity who believes that content published, distributed, or otherwise made available through any Next Gen platform or service infringes upon their intellectual property rights may submit a formal DMCA claim through the designated claims portal located at nextgenstudiosus.com/legal/dcma.

12.1 — Roblox Library Exemption DMCA claims shall not be accepted, reviewed, or processed in connection with any asset that was made freely and publicly available in the Roblox Creator Marketplace at the time the asset was obtained and used by Next Gen Studios. Any claim submitted in connection with such publicly listed assets will be closed without review.

12.2 — Music Claims & License Documentation Next Gen Studios maintains timestamped documentation evidencing any "free for profit," "no copyright," or conditional free-use licenses in effect at the time any music asset was obtained and used. If a rights holder believes that a licensing condition was violated despite such documentation, they retain the right to submit a Music DMCA claim, which will be reviewed against our records in good faith.

12.3 — Resolution Finality & Re-Submission Prohibition Once a DMCA claim has been formally resolved — whether Approved, Denied, or Resolved — that specific claim is considered permanently closed and may not be resubmitted. Attempting to submit a previously resolved claim constitutes a bad-faith filing and will be closed without review.

12.4 — False or Bad-Faith Claims Submitting a DMCA claim that you know to be false, materially misleading, or made in bad faith is a violation of these Terms and may expose the claimant to liability under 17 U.S.C. § 512(f) of the Digital Millennium Copyright Act. Next Gen Studios reserves the right to seek all available remedies against bad-faith claimants.

Section 13 Governing Law & Dispute Resolution These Terms of Service and any dispute arising out of or relating to these Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law principles. Next Gen Studios is committed to resolving all disputes in the most straightforward and civil manner possible. In the overwhelming majority of cases, Next Gen Studios' first preferred course of action will be to simply remove the disputed content and communicate directly with the claimant. In the event that a dispute cannot be resolved through direct communication and mutual agreement, the parties agree to the following resolution process:

Step 1 — Direct Communication: The aggrieved party shall first contact Next Gen Studios in writing at support@nextgenstudiosus.com. Next Gen Studios shall have thirty (30) calendar days to respond and attempt to reach a mutually agreeable resolution.
Step 2 — Informal Mediation: If direct communication fails to resolve the dispute, the parties agree to attempt informal mediation before pursuing any formal legal action.
Step 3 — Legal Proceedings: If the dispute remains unresolved, any legal action shall be filed exclusively in the state or federal courts located in the State of Delaware.

Because Next Gen Studios is operated by a minor, any legal proceedings involving Next Gen Studios may require the involvement of a parent or guardian as required by applicable state law.

Section 14 No Guarantees or Promises Next Gen Studios makes no representations, warranties, or guarantees — express, implied, statutory, or otherwise — regarding any aspect of its services, programs, platforms, or content. Without limiting the foregoing, Next Gen Studios specifically does not guarantee any of the following:

Specific outcomes, results, achievements, or improvements arising from participation in any course, program, or activity.
Continuity, availability, or uninterrupted access to any service, platform, or program.
Adherence to any stated or implied timeline, schedule, production deadline, or release date.
Access to specific individuals, contributors, instructors, or team members associated with the Project.
The technical performance, compatibility, or reliability of any digital platform, tool, or software used by or associated with Next Gen Studios.

All participation in Next Gen services is voluntary and provided strictly on an as-available basis.

Section 15 Limitation of Liability To the fullest extent permitted by applicable law, Next Gen Studios, its youth leadership, contributors, collaborators, affiliated programs, and any individuals associated with the Project in any capacity shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages of any kind arising out of or related to your access to or use of any Next Gen service, program, platform, or content. This limitation of liability applies to all causes of action and theories of recovery, whether based in contract, tort, negligence, strict liability, or any other legal or equitable theory, and includes but is not limited to:

Personal injury, bodily harm, or emotional distress of any kind.
Loss of revenue, profits, data, business opportunities, or goodwill.
Misunderstandings, miscommunications, or disputes between participants or contributors.
Scheduling changes, program cancellations, or modifications to content or services.
Unauthorized access to or alteration of your data or communications.
Any conduct or content of third parties accessed through or in connection with Next Gen platforms.

You expressly agree that your participation in any Next Gen initiative is entirely at your own risk, and that you assume all responsibility for any consequences, outcomes, or experiences arising from such participation.

Section 16 Modifications to Terms Next Gen Studios reserves the right to update, modify, amend, supplement, or replace any portion of these Terms at any time, for any reason, without prior notice. All changes are effective immediately upon being posted to the relevant Next Gen platform or communicated through official Next Gen channels. Your continued use of any Next Gen service, platform, or program following any modification to these Terms constitutes your full and unconditional acceptance of the modified Terms. If you do not agree to any modified Terms, your only recourse is to immediately discontinue use of all Next Gen services.

All formal legal notices, DMCA correspondence, and dispute communications must be submitted in writing to the above email address. Next Gen Studios will make reasonable efforts to respond to all inquiries within a timely manner, though response times may vary given the youth-led and evolving nature of the Project.

These Terms of Service were last updated on March 14, 2026. By continuing to use any Next Gen Studios service after this date, you acknowledge that you have read, understood, and agreed to be bound by these Terms in their entirety.
